The new ProComp Code of Conduct Compliance Programs provide the methodology and tools for clients to adopt a proactive, integrative approach to the reporting and training requirements mandated by the new Massachusetts Code of Conduct, which companies must comply with by July 01, 2009.
“This new law requires medical products companies doing business in Massachusetts to ramp up to speed quickly by July 1 in order to be compliant,” said Tom Glover, managing partner at Attain Management Resources. “We at Attain have been studying these requirements and have developed programs to assist companies become compliant efficiently within the deadline. A new set of disclosure requirements can create a level of disruption to businesses, we are ready to assist companies in this new process. The new Massachusetts Code of Conduct, the most stringent and comprehensive regulation in the nation, restricts and prohibits certain marketing and sales activities while mandating reporting and public disclosure of certain fees and compensation of $50 or more to certain healthcare practitioners. Companies interacting with Massachusetts-licensed healthcare practitioners are now required to establish an internal training program, conduct annual audits, have policies in place to investigate and correct non-compliance, and fulfill the other Code requirements. Violations could result in fines of up to $5,000 per event.
